BCCI vs Lodha: Supreme Court willing to relax few Lodha reforms

In a major relief for Board of Control for Cricket in India, the bench comprising Justice AM Khanwilkar, Justice DY Chandrachud and Chief Justice of India Dipak Misra on Thursday indicated that there might be some factors that can help neutralise some of the Lodha reforms. Though there can’t be any changes made to the original judgement of 2016 but there can be modifications made on ‘One State-One Vote’ and ‘Cooling off period’ clauses.

As there are associations which are more than hundred years old and have been contributing to the game the bench has decided to make reasonable modifications to one of the Lodha reforms, One State-One clause. But the focus remains on finalising new constitution. The voting right of member units have been an issue of concern and both the members of Cricket Club of India, Justice Chandrachud and Justice Khanwilkar said it doesn’t matter if the CCI has voting rights or not.

Justice Khanwilkar had previously spoken about the criteria to become National selector should be the number of runs scored but the defense said that some of the top level coaches have never played cricket. The bench also debated taking away full membership of universities which they feel used to be a presence in cricket during the 1970s in Ranji Trophy.

Additional Solicitor General Tushar Mehta also objected to the ban on ministers in BCCI. He feels that these people have served the country for decades and the court will do them serious injustice if they are banned.

Vinod Rai and Diana Idulji comprised the committee that filed the status report which supported the BCCI for the first time in the long going clash between BCCI and Lodha.
